Welcome to KidsToGo. These Terms of Service govern your use of the KidsToGo platform, including our website and related services. Please read them carefully before using our platform.
1. Introduction & Acceptance
KidsToGo is an online marketplace that connects parents and guardians with venues and businesses offering activities, experiences, and services for children in Portugal.
By accessing or using the KidsToGo platform, you agree to be bound by these Terms of Service. If you do not agree with any part of these terms, you must not use the platform.
These Terms of Service are effective as of April 2026 and apply to all users of the platform.
2. Definitions
- Platform refers to the KidsToGo website, applications, and all related services operated by KidsToGo.
- User refers to any parent, guardian, or individual who creates an account on the platform to browse, book, or interact with activities and venues.
- Venue refers to any business, organisation, or activity provider that lists activities or services on the platform.
- Content refers to any text, images, reviews, ratings, listings, descriptions, or other materials posted or submitted on the platform by users or venues.
- Services refers to all features and functionality provided by the platform, including activity search, booking facilitation, AI-powered trip planning, reviews, and newsletters.
- Booking refers to a reservation made through the platform for an activity or service offered by a venue.
3. Account Registration
To create an account on KidsToGo, you must:
- Be at least 18 years of age.
- Provide accurate, current, and complete information during registration.
- Keep your account credentials secure and not share them with others.
- Maintain only one account per person.
You are responsible for all activity that occurs under your account. If you suspect unauthorised access, you must notify us immediately at info@kidstogo.pt.
5. User Obligations
As a user of KidsToGo, you agree to:
- Provide accurate and truthful information in your account profile and when making bookings.
- Not misuse the platform, including attempting to access areas you are not authorised to use, interfering with the platform's operation, or using automated systems to scrape data.
- Respect the policies and rules of the venues you visit.
- Submit only accurate, honest reviews based on genuine experiences. Fake reviews, paid reviews, and reviews intended to harass or defame are strictly prohibited.
- Report any illegal content, harmful material, or terms violations you encounter on the platform using the available reporting tools.
6. Venue Obligations
In compliance with the Digital Services Act (DSA), venues listing activities on KidsToGo must:
- Provide valid and verifiable business information, including legal business name, address, NIF (tax identification number), and trade register details where applicable.
- Comply with all applicable Portuguese and EU laws, including consumer protection, health and safety, and child welfare regulations.
- Ensure that all listings, descriptions, images, pricing, and availability information are accurate and up to date.
- Respond to booking requests and enquiries in a timely manner.
- Not list any activities that are illegal, unsafe, or harmful to children.
KidsToGo reserves the right to verify venue information and to suspend or remove venues that fail to meet these obligations.
7. Content Policy
In accordance with Article 14 of the Digital Services Act (DSA), the following rules apply to all content on the platform.
Permitted Content
- Accurate and truthful activity listings with correct details about pricing, location, schedule, and suitability.
- Honest reviews and ratings based on genuine experiences.
- Appropriate images that accurately represent activities and venues.
Prohibited Content
The following types of content are not permitted on the platform:
- Illegal content of any kind, including content that violates Portuguese or EU law.
- Harmful content involving children, including any form of exploitation, abuse, or endangerment.
- Fraudulent or misleading listings, including false pricing, fabricated availability, or deceptive descriptions.
- Misleading information intended to deceive users about the nature, quality, or safety of an activity.
- Harassment, threats, personal attacks, or bullying directed at other users or venues.
- Hate speech, discrimination, or content promoting violence.
- Spam, unsolicited advertising, or promotional material unrelated to platform activities.
We reserve the right to remove any content that violates these rules. Users and venues have the right to appeal content removal decisions by contacting us at info@kidstogo.pt.
8. Content Moderation
In compliance with the Digital Services Act, KidsToGo moderates content on the platform through the following mechanisms:
- User reports: Any user can report content they believe violates these terms or applicable law using the reporting mechanism available on the platform.
- Periodic review: We conduct regular reviews of listings and user-generated content to ensure compliance with our content policy.
How We Handle Reports
- All reports are reviewed by our team within a reasonable timeframe.
- Reporters will be informed of the outcome of their report.
- Actions we may take include: content removal, issuing a warning, temporary account suspension, or permanent account termination depending on severity and frequency of violations.
- Affected users and venues may appeal moderation decisions by contacting info@kidstogo.pt.
9. AI-Powered Features
KidsToGo offers AI-powered features to enhance your experience:
- Our trip planner uses artificial intelligence to generate personalised activity recommendations based on your preferences, children's ages, location, and other factors.
- AI processing of your personal data requires your explicit consent, which you can provide or withdraw at any time.
- All AI-generated recommendations are suggestions only. Parents and guardians remain fully responsible for verifying the suitability, safety, and appropriateness of any activity for their children.
- AI systems may occasionally produce inaccurate or outdated suggestions. Always verify details directly with the venue before attending.
- You can opt out of AI-powered features at any time through your profile settings.
How Recommendations Work (DSA Article 27)
In compliance with Article 27 of the Digital Services Act, we provide the following information about how our recommendation system works:
Our AI trip planner generates personalised itineraries using the following parameters from your profile and input:
- Children's ages — to match age-appropriate activities.
- Interests and favourite categories — such as sports, arts, nature, or science.
- Sensory sensitivities — to suggest activities suitable for children with sensory needs.
- Learning style — visual, hands-on, auditory, etc.
- Energy level and attention span — to balance the day's activities.
- Budget preference — free, low-cost, or any budget.
- Indoor/outdoor preference — based on your input and weather conditions.
- Location — your chosen city or area.
- Activity ratings — safety, cleanliness, and overall ratings from other families.
- Free-text prompt details — any specific requirements you describe in your request.
How to Modify Recommendations
- Update your family profile: Adding or changing your children's ages, interests, sensory preferences, and other profile data will directly affect future recommendations.
- Add details to your request: Include specific preferences in your prompt such as “indoor activities”, “free”, “educational”, or “stroller-friendly” to steer the AI towards what you need.
- Opt out entirely: You can disable AI-powered recommendations at any time in your Privacy & Data settings.
No Automated Decision-Making
Our AI system does not make any automated decisions on your behalf. All recommendations are suggestions only — you, as the parent or guardian, choose which activities to visit and which bookings to make. No action is taken without your explicit involvement.
10. Bookings & Payments
Bookings made through KidsToGo are agreements between you and the venue. KidsToGo acts as a facilitator and is not a party to the booking contract.
- Payment processing is handled securely through Stripe, our third-party payment provider.
- Cancellation and refund policies are determined by each venue and are displayed at the time of booking. Please review these before confirming your reservation.
- Platform service fees may apply to bookings. Any applicable fees will be clearly displayed before you complete your purchase.
- Some activities may redirect you to external booking providers (such as Viator or Tiqets). In those cases, the external provider's terms and payment conditions apply.
11. Reviews & Ratings
Reviews and ratings help our community make informed decisions. When submitting a review, you agree that:
- Your review must be based on a genuine, personal experience with the activity or venue.
- Reviews must not contain personal attacks, threats, hate speech, or any illegal content.
- Venues have the right to respond to reviews posted about their activities.
- We may remove reviews that violate our content policy, and reviewers will be notified of such action.
- Reviews are rated across categories including value for money, cleanliness, accessibility, quality of service, and safety. An overall rating is calculated from these categories.
12. Intellectual Property
- The KidsToGo platform, including its design, branding, code, and original content, is owned by KidsToGo and protected by applicable intellectual property laws.
- By posting content on the platform (such as reviews or images), you grant KidsToGo a non-exclusive, royalty-free, worldwide licence to display, distribute, and use that content in connection with the operation of the platform.
- Venues retain ownership of their listing content, including descriptions and images they upload. By listing on KidsToGo, venues grant us permission to display this content on the platform and in related marketing materials.
13. Limitation of Liability
KidsToGo operates as a marketplace intermediary. As such:
- We are not responsible for the quality, safety, legality, or suitability of activities offered by venues.
- We are not responsible for the accuracy of venue listings, descriptions, pricing, or availability information.
- Parents and guardians are solely responsible for supervising their children during any activity booked through the platform.
- To the maximum extent permitted by law, KidsToGo's total liability to you is limited to the amount of fees you have paid to KidsToGo in the 12 months preceding the event giving rise to the claim.
- KidsToGo shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the platform.
14. Dispute Resolution
- These Terms of Service are governed by and construed in accordance with the laws of Portugal.
- Any disputes arising from these terms or your use of the platform shall be resolved through the competent Portuguese courts.
- For data protection complaints, you may contact the Portuguese Data Protection Authority (CNPD) at www.cnpd.pt.
- EU residents may also use the European Commission's Online Dispute Resolution (ODR) platform at https://ec.europa.eu/consumers/odr.
15. Changes to Terms
We may update these Terms of Service from time to time. When we make significant changes, we will notify you via email or through a prominent notice on the platform before the changes take effect.
Your continued use of the platform after the updated terms become effective constitutes your acceptance of the revised terms. If you do not agree with the changes, you should stop using the platform.
